Estate Planning and Administration

Representation in estate planning matters ranges from simple non-tax dispositive planning through complex multi-generation planning for large estates with substantial business or other assets.

Advanced lifetime management, federal estate and gift tax, generation-skipping transfer tax, and dispositive planning integrates one or more general or limited family partnerships, revocable living trusts, and wills. Also included are other trusts customary to integrated planning, such as generation-skipping for children and other beneficiaries, irrevocable life insurance trusts, and special purpose trusts for a spouse or others.

Additionally, we negotiate and prepare lifetime planning tools for clients, including revocable and irrevocable Trusts, Durable Powers of Attorney, Directives to Physicians under the Texas Natural Death Act, Sibling and Family Agreements, and other appropriate ancillary documents needed for lifetime planning.

The firm provides complete estate administration services, including probate, estate settlement, and federal estate tax return preparation.

In addition to direct representation of clients, the firm is pleased to provide services in this area to other attorneys on an associate counsel or consulting basis.

Probate and Trust Litigation

Our firm represents clients involved in all forms of estate and trust litigation. In the estate context, we represent clients in Will contests, claims against decedent's estates, determination and enforcement of beneficiary rights, including breach of fiduciary duty claims against the executor or administrator of the estate, and proper execution of executor and administrator duties.

In the trust context, our firm represents beneficiaries seeking to determine or enforce their rights under the particularities of the governing trust, including obtaining a full and proper Accounting and to hold trustees liable for breach of their fiduciary duties. We also represent trustees both in an advisory capacity to ensure proper fulfillment of the trustee's duties, and, in the event of conflict, in defense against claims that the trustee breached his or her duties.

Consumer Law

The firm offers legal services in regard to consumer transactions. This area of our practice includes Deceptive Trade Practices Act cases involving misrepresentations, breach of warranty, and/or violations of the Insurance Code, as well as claims of fraud and those arising under the litany of consumer protection statutes enacted in Texas, including the Lemon Law.

In addition, our firm guides our clients through negotiation, execution, and enforcement of contract obligations. We also handle contract disputes, including but not limited to landlord and tenant conflicts.

Small Business Law and Commercial Litigation

Our representation supports small businesses beginning at formation, continuing through operations, and providing litigation support when necessary. We assist with negotiations, contract formations, and business disputes. The firm also provides litigation support to enforce contractual obligations, such as non-compete agreements. Further, we consult with and provide defense services to small businesses in regard to compliance with both state and federal employment regulations.
